TRUCK LIFTED TOO HIGH
In February 2018, our clients went to Gold Star Auto’s dealership in Sacramento based on an online advertisement they had seen for a used 2007 Dodge Ram truck. Our clients allege that when they arrived at Gold Star Auto they were met by a salesperson who represented himself as being the owner of the used car dealership. Our clients asked the owner about the 2007 Dodge Ram they had seen advertised by Gold Star Auto. They allege the owner expressly represented to them that the 2007 Ram truck was in very good condition, and that it was in demand, partly because it had a large lift kit installed. Our clients also allege that the owner told them that the Carfax was clean, but never gave them a copy and told them that he/Gold Star Auto had just installed, brand new, very expensive tires on 2007 Ram. Our clients further allege that they specifically informed the owner that they would not consider purchasing the Dodge Ram unless it were covered by a warranty. They allege that they were told that Gold Star Auto was providing an extended warranty on the 2007 Dodge Ram truck and provided them with a document entitled “GWC Warranty Contract Application” relating to the 2007 Ram Truck.
Long story short, our clients allege that Gold Star Auto not only significantly overcharged them for the license fees Dodge Ram but misrepresented the extended warranty. When the power steering in the 2007 Ram ceased to operate, our clients took it for repairs under extended warranty only to find out that the warranty was void from the start. They allege repairs were denied because, although Gold Star Auto sold them the 2007 Dodge Ram truck with a six-inch lift kit, the warranty only covered lift kits up to four-inches. Additionally, our clients allege they have learned that the Carfax report on the Vehicle was not clean as represented by Gold Star Auto, but indicated damage was reported prior to their purchase. Our clients allege they have experienced other operational problem with the 2007 Ram as well.
The firm of Rosner, Barry & Babbitt has filed suit in Sacramento County Superior Court to obtain a repurchase of the 2007 Dodge Ram and damages for our client.
