Our client’s lawsuit alleges that prior to November 1, 2018, our client saw South Coast Mitsubishi’s advertisement for a “new” 2018 Mitsubishi Outlander. Additionally, the advertisement listed an MSRP of $22,925 with an advertised “Dealer Discount” that would lower the price by $5,120, down to $17,805. After the sale, our client discovered the 2018 Outlander was not only used, but illegally sold over its advertised price. Our client alleges South Coast Mitsubishi represented and advertised that the Vehicle was new when it was used; represented and advertised the Vehicle would be sold at a cash price of $17,805 and sold it above the advertised price; charged Plaintiff a undisclosed, non-itemized “destination fee” of $995; misrepresented the characteristics, uses, and benefits of the Vehicle warranty as the warranty had begun to run prior to the sale to Plaintiff; and failed to post a Buyers Guide on the Vehicle.
