THE WARRANTY THAT WASN’T
In February 2019, our client when to La Mesa RV in West Sacramento, Yolo County, to buy a motor home. Our client alleges she explained to the La Mesa RV salesperson that she was nearly 60 years old, single, and a first time Recreational Vehicle buyer. She told La Mesa RV she was planning on traveling on her own with a motor home. She asked La Mesa RV which motor coach was the most user friendly for a first time RV owner. The La Mesa RV sales person said the Vehicle, a new 2019 Hymer AKTIV motor home with the lithium batteries, was a great pick for her needs. She said she never heard of Hymer. Our client further alleges that the La Mesa RV salesperson assured her that Hymer was a well-respected company, with a long history, and that the motor home came with Hymer’s 6-year warranty. Our client further alleges that the motor coach exhibited defects from the first day of ownership. Our client alleges that at the time the Hymer Recreational Vehicle was being sold to her, La Mesa RV knew that Hymer was in Receivership and not honoring its warranties. Neither Hymer, nor La Mesa RV, would repair her defective RV.
