Velazquez v. Victorville Nissan, Inc. and Nissan North America, Inc. – San Bernardino County
New case filed against Victorville Nissan and Nissan North America over the sale of a Certified Pre-Owned (CPO) 2017 Nissan Altima. Our client alleges Victorville Nissan (1) falsely advertised the Altima as a Nissan CPO when the Vehicle should not have passed Nissan’s certification standards; (2) misrepresented the Altima’s accident and damage history; (3) sold the Altima as a Nissan CPO without disclosing known defects to the Altima; (4) violated Vehicle Code § 11713.18; (5) failed to provide Spanish-language translations of the purchase documents; (6) added aftermarket items to the purchase contract without our clients’ knowledge; (7) failed to provide a copy of the warranty terms as required by the Song Beverly Consumer Warranty Act, Magnuson Moss Warranty Acts, and Federal Law; (8) sold the Altima for more than advertised price; (9) falsely advertised that Certified pre-owned cars are carefully checked for superiority and reliability; and (10) failed to provide a Buyer’s Guide for the Altima. Our client alleges Nissan North America (1) falsely advertised that Nissan is involved in certifying vehicles under the Nissan CPO program; (2) falsely advertised that “only Nissans that meet high standards qualify for Certified Pre-Owned status”; (3) falsely advertised that Nissan dealerships will tell consumers the history of Nissan CPO vehicles; (4) falsely advertised that mechanics inspecting Nissan CPO vehicles are specially trained by Nissan; (5) falsely advertised that Nissan requires Nissan dealerships to inspect the appearance of vehicles under the Nissan CPO program; (6) falsely advertised that Nissan requires Nissan dealerships to inspect the frame/unibody for damage under the Nissan CPO program; (7) allowed Victorville Nissan to certify the Altima; (8) violated Vehicle Code § 11713.18(a); (9) allowed Nissan dealers to sell wrecked and damaged vehicles as certified; and (10) failed to train Nissan dealers on how to certify vehicles under Nissan’s CPO program.
