TUSTIN NISSAN
Rosner, Barry and Babbit’s Auto Fraud Legal Center has filed a lawsuit against Tustin Nissan, alleging that the dealership sold a 2014 Nissan Versa and failed to disclose prior accident damage. (Martinez v. Forman Donald, et al. Orange County Superior Court Case No. 30-2018-00974537-CU-CO-CJC.) Our client discovered the undisclosed prior accident on his own, and even tracked down the police report.
During the course of this lawsuit, we have learned that Nissan North America sued Tustin Nissan for fraud after it discovered that Tustin Nissan filed more than 7,000 “non-compliant” warranty claims between June 23, 2014, and March 20, 2015, representing 96 percent of all the store’s claims for the period. This then begs the question. If Nissan North America knew or should have known that Tustin Nissan was submitting 7,000 “non-compliant” claims in 2015, then why did Nissan North America certify our client’s car in 2017?
