Our client bought a Smart Fortwo from Top Notch Auto Sales, a “buy here pay here” (BHPH) dealership. She alleges Top Notch failed to comply with the laws for BHPH dealers because it sold the car “as is” and didn’t post a sign or sticker on the vehicle listing the fair market value.
