Our client purchased a Certified Pre-Owned 2019 Dodge Challenger from Kearny Mesa Chrysler, Dodge, Jeep, Ram in San Diego, California. Soon thereafter, he noticed the paint was uneven, and the vehicle seemed damaged. A mechanic who had worked on the vehicle believed it had been in an accident before. After investigating the case, we found out that the certification checklist was inaccurately marked, and the vehicle had a prior rental history, which the dealer had not properly disclosed to our client. A dealer is required to disclose prior rental status of a vehicle to buyers because, among other things, rental cars are often repaired in-house and therefore the repairs are not submitted to vehicle history reporting agencies such as Carfax.
