Our client bought a 2014 Honda Accord from Top Notch Auto Sales in San Jose, a buy-here-pay-here (“BHPH”) dealership, and asked if the vehicle had been in any accidents. After being told that the vehicle had no prior accidents, he bought the Honda…and later discovered it had been in a prior accident. Top Notch Auto Sales allegedly concealed the vehicle’s prior accident damage, gave our client a warranty not complying with the laws for BHPH dealers, and overcharged the Vehicle License Fee.
