Picaso v. Lithia of Lodi, Inc. – Alleged Misrepresentation of Accident History or Breach of Warranty
In the case of Picaso v. Lithia of Lodi, Inc., Mr. Picaso alleges Lodi Toyota told him the pre-owned 2020 Toyota Camry had never been in an accident. He claims to have taken the vehicle to another Toyota dealer for repair under the factory warranty after the dashboard began intermittently displaying a low brake power warning. He alleges Toyota Motor Sales, U.S.A., Inc., denied warranty coverage on the ground the defect resulted from an impact to the front right, which did not happen during the time he owned the vehicle. Mr. Picaso alleges either (1) the defect resulted from an accident and Lodi Toyota committed fraud or (2) the defect did not result from an accident and Toyota breached its express warranty.
