Perez v. Valencia Holding Company, LLC – SETTLEMENT UPDATE

In the case of Perez v. Valencia Holding Company, LLC, Mr. Perez alleged Mercedes Benz of Valencia (then owned by Valencia Holding Company, LLC) duped him into purchasing a “Certified Pre-Owned” 2014 Mercedes-Benz CLS63 AMG by representing it had never been in any accidents. In fact, Mr. Perez alleged, the vehicle had sustained structural damage in an accident before he bought it. It is against California law for a dealer to sell a used vehicle as “certified” if it “has sustained damage in an impact . . . that after repair prior to sale substantially impairs the use or safety of the vehicle” or if “[t]he dealer knows or should have known that the vehicle has sustained frame damage.” (Veh. Code §§ 11713.18(a)(4)-(5).)
