NEW CASE FILED AGAINST GARDEN GROVE KIA
Rosner, Barry & Babbitt has filed a new case against Ford Motor Company and Garden Grove Kia. In the lawsuit we allege that Ford Motor Company’s warranty it provided on a 2012 Ford Focus, equipped with a Dual Power Shift Transmission, is deceptive.
Ford’s warranty covers defects in design. See, Daniel v. Ford Motor Company, 806 F.3d 1217, 1224-25 (9th Cir. 2015). The transmission has a defective design, and Ford can’t fix it. We believe the shudder, hesitation and jerking when you accelerate will never go away.
We also sued the selling dealer, Garden Grove Kia. This dealership advertises its vehicles as “Garden Grove Kia Certified.” California law states that in order to use the term “certified” or any similar phrase, the dealer MUST provide the buyer with a completed inspection report prior to sale. See, Vehicle Code § 11713.18(a)(6). We believe Garden Grove Kia fails to provide any report to its buyers.
Garden Grove Kia advertises that the “certified” vehicles come with a 10 year warranty. We believe that this is simply a ruse to get people to buy a service contract. Our clients ended up paying $500 for the warranty that Garden Grove Kia had advertised came with the vehicle.
