Msalam et al. v. Elite Motor Cars & Peter Pan BMW – San Mateo County

New case filed against Elite Motor Cars and Peter Pan BMW. Our client purchased a 2014 BMW M6 from Elite Motor Cars. Our client alleges the M6 had aftermarket software which affected the engine and was not disclosed by Elite Motor Cars. Just a few months after purchase, the engine needed to be replaced at a cost of more than $40,000.00! Peter Pan BMW agreed to remove the aftermarket software as part of the repair. Our client alleges the Check Engine Light came on almost immediately after they picked up the M6 from Peter Pan BMW. Just a few weeks after the $40,000.00 repair, Peter Pan BMW told our clients the M6 needed to have the engine replaced again and that BMW of North America was not going to honor the warranty on the replacement engine because of the aftermarket software.
