McMurray v Acura of Fremont

DID YOU PAY MORE THAN THE “ADVERTISED PRICE” FOR YOUR CAR, TRUCK OR SUV?

That’s just one of the things we alleged happened to our client, a mother of 3, when she purchased her 2015 Acura MDX. Our client saw an on-line advertisement for a Certified Pre-Owned (CPO) 2015 Acura MDX for sale at Acura of Fremont located in the City of Fremont. The representation that the vehicle was Acura “certified” was important to her because she believed that the Acura MDX would have been thoroughly inspected and therefore, safe for her family. Our client sent a text to the dealership with a copy of the ad and asked if the car was still on the lot for sale. She was told it was. She drove a long distance to the dealership with one of her 3 children at her side. After being held at the dealership for hours, she was given a number of documents to sign all at once. She signed them and went home. A few days later she was looking at the pack of documents the dealership handed her and saw that Acura of Fremont charged her $3,000 over and above what the dealership’s advertised price for the Acura MDX. She also discovered that a portion of the driver’s side of the car had apparently been repainted (poorly). It appeared some type of repair was made to cover prior damage. This accident damage was never disclosed to our client. After contacting the dealership and not receiving satisfaction (and being told that the manager who had been responsible for selling the her Acura MDX had been fired) she contacted Rosner, Barry & Babbitt for help. Our firm is filing a lawsuit against Acura of Fremont, for among other acts, selling our client her Acura MDX for $3,000 over its advertised price.

Lilia Guizar was my attorney in a recent fraud case and I am so impressed with the outcome. The process was quick and easy. This legal team is amazing! Yes our case took time but they were always ready to answer any of our questions and we had a lot!
