DRIVETIME SELLS VEHICLE WITH CONCEALED ACCIDENT DAMAGE AND CONCEALED PRIOR-RENTAL HISTORY

Our clients bought a Dodge Avenger from DriveTime, a “buy here pay here” (BHPH) dealership. DriveTime didn’t disclose that the vehicle was a prior rental vehicle, and concealed the vehicle’s prior history of severe accidents. DriveTime also failed to comply with the laws for BHPH dealers because it sold the car with a warranty that didn’t comply with the laws for BHPH warranties and didn’t post a sign or sticker on the vehicle listing the vehicle’s reasonable market value.
