Our client bought a 2011 Ford Flex from Auto Retail Group in February 2021. California law requires a dealer to have a valid smog certificate issued within the last 2 years for the vehicle at the time of sale. However, Auto Retail Group allegedly didn’t have the Ford smogged before selling it to our client, despite charging him $50.00 for the pre-sale smog check and $8.25 for the smog certificate. The Ford then had its check-engine light light up, and when Auto Retail Group told our client to have the Ford smogged, the Ford allegedly failed two post-sale smog checks.
