Our client bought a 2008 BMW 750i from Lucas Auto Center, a Buy-Here-Pay-Here (“BHPH”) dealership, to whom she made her payments. Lucas Auto Center allegedly gave our client an express warranty for the engine and transmission only, which required our client to pay 50% of the repair costs – both of which are illegal for BHPH dealers. When our client allegedly didn’t pay her one-half of an illegal $4,000 repair bill, Lucas Auto Center repossessed the BMW – and did not give her a post-repo Notice of Intention as required by law that stated what she would have to pay the get the BMW back.
