DEALER FAILS TO REGISTER MERCEDEZ-BENZ AFTER SALE
In January 2020, our client went to Auto Gallery in the city of Hayward in Alameda County to purchase a reliable used car. Auto Gallery showed our client a 2008 Mercedes-Benz CL-Class which it was offering for sale.
Our complaint alleges, in addition to other matters, that the Hayward Auto Gallery failed, in violation of the Automobiles Sales Finance Act (“ASFA”), to disclose the deferred down payment for the 2008 CL-Class vehicle; Auto Gallery violated the Single Document Rule under the Civil Code by not listing the terms of the deferred down payment for the purchase and sale of the 2008 Mercedes-Benz CL-Class; the Hayward Auto Gallery failed to submit the transfer of title documents to the DMV within the required time; failed to register the 2008 Mercedes-Benz to our client after the purchase; failed to deliver the certificate of ownership to the Mercedes our client and failed to post a required Buyers Guide on the 2008 Mercedes-Benz.
