Davis v. Manchester Auto Group

VEHICLE WAS SOLD IN SEVERE STATE OF MECHANICAL DISREPAIR. PLAINTIFF CAN NO LONGER DRIVE THE VEHICLE, OR EVEN START IT.

In November 2017, Plaintiff and Manchester Automotive Group, located in Los Angeles, entered into Retail Installment Sale Contract for the purchase a used 2009 Volkswagen CC. At the time of the purchase, Plaintiff asked Manchester Automotive Group about the mechanical condition of the 2009 Volkswagen CC. Manchester Automotive Group represented to Plaintiff that the vehicle was a good car and did not have any mechanical problems. A few days after Plaintiff purchased the Volkswagen, the Check Engine light illuminated on the dashboard and the Volkswagen would not accelerate. Manchester Automotive Group first failed to repair, and then refused to repair, our client’s Volkswagen CC. Our client sought help from the law firm of Rosner, Barry & Babbitt after finding out that the entire engine needed to be replaced and that the 2009 Volkswagen CC was in such bad shape that it could not even be driven. When investigating this matter for our client, the Auto Fraud Legal Center discovered facts leading to additional allegations. Manchester Automotive Group was a Buy-Here-Pay-Here dealership and as such, is required to comply with certain legal requirements when selling vehicles. The dealership failed to fulfill certain legal obligations with regard to the sale. The Auto Fraud Legal Center has alleged in the lawsuit filed on behalf of our client, that Manchester Automotive Group failed to provide the proper required warranty, and failed to attach the required Reasonable Fair Market Value sticker to the 2009 Volkswagen CC when offering it for sale. In addition, our firm is alleging that Manchester Automotive Group illegally charged our client $1,000 over the advertised price of the vehicle and misrepresented the down payment on the sales contract.
