King v. Parkway Cadillac Hummer GMC

In September 2017, our clients went to Parkway Cadillac Hummer GMC in the City of Valencia, County of Los Angeles, to purchase a new SUV. They wound up signing a sales contract for a new 2017 GMC Yukon. Our clients took delivery of the GMC Yukon and drove home. The Retail Installment Contract, which Parkway Cadillac Hummer GMC had our clients sign stated that the seller had a 10-day right to cancel the contract. Our lawsuit alleged that shortly after purchase Parkway Cadillac Hummer GMC sent a Notice Of Election To Cancel the contract. It was also alleged that our clients informed Parkway Cadillac Hummer GMC that they accepted the cancelation of the sale of the 2017 GMC Yukon and wanted to know when and where they should return the vehicle. The lawsuit alleges that our clients were told that the dealership’s business policy and practice was to “automatically” send this notice out to all buyers when the financing exceeds a certain timeframe. Our clients further allege they were told that that the dealership had now found financing and Parkway Cadillac Hummer GMC would not allow our clients to return the 2017 Yukon. Our lawsuit alleges that our clients repeatedly tried to return the 2017 GMC Yukon, but Parkway Cadillac Hummer GMC, continued to insist the sale contract was still in force. Our lawsuit alleged these actions gave rise to Causes of Action, among other laws, for violations of the Consumers Legal Remedies Act. The Auto Fraud Legal Center demanded a repurchase of the 2017 GMC Yukon, a refund of our client’s down payment, a refund of their monthly payments, a payoff of the Yukon loan, plus payment of legal fees and costs.

This legal team is amazing! Yes our case took time but they were always ready to answer any of our questions and we had a lot!
