AMERICAR AUTO FINANCE FAILS TO GIVE SPANISH-LANGUAGE CONTRACT TO SPANISH-SPEAKING CUSTOMER, VIOLATES SINGLE-DOCUMENT RULE, AND OVERCHARGES OFFICIAL FEES

Our client speaks Spanish and alleges he spoke only Spanish with the sales staff at Americar Auto Finance when he purchased a 2008 Ford Edge. However, he wasn’t given Spanish-language translations of his sales contract! He also alleges Americar Auto Finance overcharged him for the vehicle license fee and registration fee, and also falsely reported his downpayment by making him sign a separate “promissory note” in violation of the single-document rule. California law requires that if the sales transaction is negotiated primarliy in Spanish, Chinese, Tagalog, Vietnamese, or Korean and you don’t have an adult come with you to translate, the dealership MUST give you copies of your sales documents in the language that was used.
