ACURA “BRAKES” OUT A LEMON

Our clients allege that in February 2019 they leased a new 2019 Acura RDX from DCH Acura of Temecula, DCH Acura is an authorized Acura/Honda retail dealership doing business in the city of Temecula, and county of Riverside. Our clients’ lawsuit alleges the 2019 Acura began exhibiting material defects during Honda’s warranty period. These defects include a loud and irritating brake noise and a malfunctioning “infotainment” system. Our client alleges Acura was well aware it has a problem with the the brakes on its 2019 Acura RDX and DCH Acura of Temecula, admitted the brake noise existed in our client’s Vehicle, but told our clients Acura had no fix for the problem.

The lawsuit further alleges our clients took the 2019 RDX to Acura’s authorized repair facilities to remedy for the defects on repeated occasions and Acura was simply unable to repair the defects. Our clients allege that Acura’s inability to repair the RDX required it to be repurchased it as a “lemon.” Finally, our clients attempted to handle the situation alone, requesting Honda to take back the 2019 Acura RDX and refund their money. Acura/Honda failed or refused this repurchase request. Acura/Honda corporate told our clients that they had to wait until Acura was able to find a “fix” for the brake problem. That is when our clients sought help from the Auto Fraud Legal Center. Rosner, Barry & Babbitt is suing Acura/Honda to force it to buy-back the Honda and refund our clients’ money.
