(2) DEALERSHIP ALLEGEDLY SELLS AN ACCIDENT-DAMAGED CERTIFIED-PRE OWNED VEHICLE AS ACCIDENT-FREE! — Larson v. KR Automotive, Inc dba Escondido Hyundai, et al

Our clients purchased a “Certified Pre-Owned” 2014 Hyundai Sonata from Escondido Hyundai. Our clients wanted a vehicle that had never been in an accident. Hyundai Motor America advertises to consumers that Hyundai Certified Pre-Owned vehicles are “like new” and “Better Than Used.” So, when Escondido Hyundai told our clients that the vehicle had never been in any accidents, they believed it. In reality, the vehicle was involved in a pre-sale accident and was improperly repaired; the front-bumper was held in place with a wood block and construction screws covered with body-filler and paint. When our clients asked for a refund, the dealership denied having any basis to know about the improperly repaired accident-damage, and refused. Our clients turned to the Auto Fraud Legal Center for help. We filed a lawsuit in San Diego County Superior Court, alleging Hyundai Motor America and Escondido Hyundai committed fraud. Escondido Hyundai agreed to repurchase the vehicle for a full refund, and to pay our clients’ attorneys’ fees and costs.
