This Complaint seeks relief on behalf of the following two proposed classes:
Class 1: All persons who, in the four years prior to the filing of this complaint, (i) purchased a vehicle from Allstar for personal use; (ii) signed a Retail Installment Sale Contract (“RISC”) for the same vehicle that was dated a date prior to the date it was signed, and (iii) involved financing at an annual percentage rate greater than 0.00%.
Class 2: All persons who, within the last four years, (i) purchased a vehicle from Allstar for personal use, (ii) signed a RISC, and (iii) were charged “California Tire Fees” on their RISC for one or more used tires, including the spare tire.
