Dian Cruz v. JKC Palm Springs Automotive, Inc. dba Team Kia of El Cajon, et al. – San Diego County

New auto fraud case filed regarding our client’s certified pre-owned 2019 Kia Sorrento. Our client alleges the car she was sold was involved in a prior accident but Team Kia of El Cajon did not tell her that. On that basis, she alleges Team Kia of El Cajon: 1) misrepresented or concealed the vehicle’s accident history; (2) misrepresented or concealed the vehicle’s damage history; (3) misrepresented or concealed the vehicle’s defects; (4) violated Vehicle Code § 11713.18(a); (5) sold the vehicle as certified when it did not qualify to be certified under Kia’s certification standards; (6) misrepresented the vehicle’s status as certified by Kia; (7) represented the vehicle had not been in an accident when it had; and (8) represented the vehicle had not been damaged when it had.
