Pulliam v. HNL Automotive, Inc. – Los Angeles Superior Court

Case update. In January 2021 the court of appeal affirmed an award of $169,000.00 in attorney’s fees against TD Auto Finance, an FTC Holder. The case is currently pending before the California Supreme Court at TD Auto Finance’s request. On January 18, 2022, the FTC issued an advisory opinion which expressly noted the appellate court in Pulliam was correct (and also noted the cases relied upon by TD Auto Finance are wrong)! According to the FTC, a Holder of an installment sale contract can be liable for attorney’s fees and costs under state law.
