Sanchez v Puente Hills Nissan

CAR DEALER GOT MORE THAN IT BARGAINED FOR WHEN IT SENT A FORM CANCELATION LETTER UNDER THE “10-DAY RULE.”

Recently, our client purchased a new 2018 Nissan Rouge from Puente Hills Nissan, in the City of Industry in Los Angeles County. Most car buyers are unaware of it, but If you look on the backside of a Retail Installment Sale Contract, you will usually find a clause entitled “Seller’s Right To Cancel.” This is commonly known as the “10-Day Rule.” Unfortunately, the 10 Day Rule is completely one-sided. The seller gets the right to cancel, but you, the buyer, do not have that same right. There is “No Cooling Off Period” for the buyer of a new car or truck in California (meaning there is no right for you to cancel.) So, after our client purchased his 2018 Nissan Rouge, he received a letter from Puente Hills Nissan stating the dealership elected to “cancel” the contract. Our client decided if they wanted to cancel he would return the car. However, when he got to the dealership, he was told that the contract was not cancelled and that he could not return the car because the dealership already financed it. Our client stood his ground and told Puente Hills Nissan that he was returning his Nissan Rouge. The dealership continued to refuse to accept the return of the car. When our client told the dealer that what they were telling him was unacceptable Puente Hills Nissan told him, “We’ll just have to let your lawyers and our lawyers fight about it.” That’s when he came to the Rosner, Barry & Babbitt for help and that’s what we did. We here at the Auto Fraud Legal Center see this as an unlawful business practice and sued Puente Hills Nissan to take back the 2018 Nissan Rouge, return our client’s money, pay off his auto loan and pay his attorney fees and costs.
