NISSAN SHAKES ANOTHER LEMON FROM THE “CERTIFIED PRE-OWNED” TREE

Our client’s lawsuit against Nissan North America and Mossy Nissan of Escondido alleges that in August 2019, Mossy Nissan of Escondido sold our client a used 2016 Nissan Rogue. Mossy Nissan sold the 2016 Rogue to our client as “Nissan Certified Pre-Owned” vehicle that was thoroughly inspected and came with an accompanying Nissan Certified Pre-Owned warranty.
In addition, Mossy Nissan added its own 30 day/1,000 mile warranty on the 2016 Rogue to make the sale. The lawsuit alleges the Nissan Rogue was delivered to our client with serious defects and nonconformities including engine noise, shaking, and vibrations. It is alleged the Rogue was sold by Mossy Nissan in breach of the implied warranty of merchantability.
Our client took the 2016 Nissan Rogue to Mossy Nissan, an authorized Nissan repair facility for repairs of these defects on multiple occasions. Both Nissan and Mossy failed to repair the defects. Our client lost faith in the 2016 Nissan Rogue and in Nissan’s ability to repair it.
Our client requested that Nissan repurchase or replace the Vehicle. Nissan knowingly and willfully refused her demands. Mossy Nissan has also failed and refused to repurchase the 2016 certified Rogue. Our client then turned to the Auto Fraud Legal Center for help. Our law firm has sued Nissan North America and Mossy Nissan to buy-back our client’s certified pre-owned Nissan Rouge and refund her money.

Lilia Guizar was my attorney in a recent fraud case and I am so impressed with the outcome. The process was quick and easy. This legal team is amazing! Yes our case took time but they were always ready to answer any of our questions and we had a lot!
