Camacho v. Mercedes-Benz of Rocklin

REALLY? THEY CALLED THIS A “CERTIFIED” MERCEDES- BENZ!!

In October 2014our client went to Mercedes-Benz of Rocklin in Placer County and purchased a 2009 Mercedes-Benz S550. This 2009 Mercedes-Benz S550 was represented by Mercedes-Benz of Rocklin as a “Mercedes-Benz Certified Pre-Owned Vehicle.” (“CPO”). Our client alleged in his lawsuit that he was told by the Mercedes dealership that the car was a CPO, and therefore, of the highest quality and he would have no problems with the 2009 Mercedes-Benz S550. His lawsuit alleged, that Mercedes-Benz and Mercedes-Benz of Rocklin actively market and advertise that vehicles designated as Mercedes-Benz Certified Pre-Owned have passed a “a painstaking certification process” and must “meet stringent criteria and pass a rigorous inspection.” Our client decided to purchase the Vehicle because it was a CPO, under warranty, and because Mercedes-Benz of Rocklin represented it was in an excellent condition with no damage. Our client alleged that within two weeks of the purchase of the Mercedes-Benz S550, he started having mechanical problems. The Mercedes-Benz S550 started blowing smoke out of the tail pipe, had a hard downshift, and a hesitation when pulling from a stop. Our client alleged that the repairs were unsuccessful and he also learned for the first time that the car had been reported to have been in an accident before he ever bought it. After filing a lawsuit for him, the Auto Fraud Legal Center, was successful in having his money refunded, his money back, his loan paid off and his attorney’s fees paid.
