A Dealer Must Label Vehicles to Tell Consumers if a Vehicle Declared a Total-Loss by an Insurance Company

Our client purchased a used 2012 BMW 328i from Stellar Auto in Burbank, California. Before he bought the car, Stellar told our client had a clean title. However, when our client tried to trade-in the vehicle, he found out the truth: it had been declared a total-loss by an insurance company, and should have been disclosed to him by Stellar as a salvage vehicle. Our client turned to the Auto Fraud Legal Center for help. We filed a lawsuit on his behalf in the Los Angeles County Superior Court, which alleged that the dealership committed fraud and violated various consumer protection statutes in the sale of the vehicle. The case settled when the dealership agreed to provide a full refund on the vehicle and pay our client’s attorney’s fees and costs.
